Fresno Medical Spa in Legal Trouble for Botox and Laser Hair Removal

One of the legal issues rising in medical spas is the unlawful practice of medicine. A doctor and three registered nurses will be arraigned Monday in Fresno County Superior Court on felony charges of unlawful practice of medicine involving Botox injections and laser hair removal in northeast Fresno.
The doctor and three nurses posted bail after a criminal complaint was filed in July.
Two of the nurses are charged with four counts of unauthorized practice of medicine; while one faces three charges of unauthorized practice of medicine; and the doctor is charged with aiding and abetting the unlicensed practice of medicine.
An attorney for the doctor, however, said Thursday that the doctor and the three nurses are innocent.
Fresno defense lawyer Mark Coleman said the doctor is always present at the clinic when the nurses give Botox injections or do laser hair removal treatment under his guidance. He also said the nurses have completed extensive training in the cosmetic procedures.
Fresno attorneys Christopher Caine, who represents one nurse, and W. Scott Quinlan, who represents another nurse, also deny any kind of wrongdoing by the defendants. Coleman and Quinlan said it is their hope to resolve the case without criminal charges.
The other nurse’s attorney, Mark Moktarian of Los Angeles, could not be reached to comment.
